These Terms & Conditions ("Agreement") are entered into between Matthijs Kok ("Service Provider") and the client ("Client") upon the commencement of any project or service request. By engaging with the services provided by Matthijs Kok, the Client agrees to the following terms.
We are Matthijs Kok ("Company," "we," "us," or "our"). We operate the website www.matthijs.work (the "Site"), along with any related products and services that reference or link to these legal terms (collectively, the "Services").

These Legal Terms establish a binding agreement between you, whether as an individual or representing an entity ("you"), and Matthijs Kok, governing your access to and use of the Services. By using the Services, you confirm that you have read, understood, and agreed to comply with these Legal Terms. If you do not agree to these terms, you are not permitted to use the Services and must stop using them immediately.
Any additional terms or conditions posted on the Services are considered part of this Agreement. We retain the right to update these Legal Terms at any time and for any reason, at our discretion. Notification of changes will be provided by updating the "Last Updated" date, and you agree to waive any right to receive individual notice of each modification. It is your responsibility to regularly review these Legal Terms to stay informed. By continuing to use the Services after updated terms are posted, you acknowledge and accept the changes.
The Services are intended for users aged 18 and older. Individuals under 18 are not permitted to use or register for the Services.

The Definitions section serves to clarify key terms used throughout this Agreement. By defining these terms upfront, both parties—the Service Provider and the Client—will have a shared understanding of important concepts that are referenced repeatedly in the document. This helps prevent any misunderstandings or ambiguities about what specific words mean in the context of the project. Each defined term provides clarity and ensures that the Agreement is interpreted consistently by both parties.
1.1 "Agreement" refers to these Terms & Conditions.
1.2 "Services" refers to any multimedia design and creative concept development provided by Matthijs Kok, including but not limited to graphic design, animation, video production, web design, and interactive media.
1.3 "Deliverables" refers to the final product or service delivered to the Client as per the scope of the project.
1.4 "Client" refers to any individual or entity purchasing services from Matthijs Kok.
Services Provided
Matthijs Kok, a Multi-Media Designer and Creative Concept Developer, is an innovative professional known for creating impactful, visually compelling multimedia content across various platforms. His expertise combines creativity with technical skill to develop cohesive visual narratives that effectively communicate brand messages and meet project objectives. From concept to execution, Matthijs works across multiple mediums, including graphic design, animation, video, web, and interactive media. His collaborative approach ensures that all creative assets resonate with target audiences, align with brand visions, and meet deadlines, while constantly pushing the boundaries of digital and multimedia design.
2.1 Matthijs Kok will provide multimedia design and creative concept development services as agreed upon with the Client. Specific project terms will be set forth in a separate project brief or proposal, agreed upon prior to the commencement of the project.
2.2 Changes or additions to the scope of services may result in additional costs and timelines. Any such changes must be agreed to in writing by both parties.
User Responsibilities
3.1 The Client agrees to provide all required materials, assets, information, and feedback necessary for the completion of the project in a timely manner.
3.2 Failure to provide these materials may result in delays, for which Matthijs Kok will not be held liable. Delayed provision of assets may lead to renegotiation of deadlines.
3.3 Any necessary approvals must be provided by the Client promptly, and any reworks or additional rounds of revisions not included in the original agreement may incur extra fees.
Prohibited Activities
4.1 You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Specifically, you agree not to:
4.1 Unauthorized Use
(A) Use the Services to engage in any unlawful or fraudulent activity.
(B) Access or use the Services for any purpose that is illegal, unethical, or otherwise prohibited by these Legal Terms.
(C) Use automated tools (such as bots, scrapers, or crawlers) to access or gather information from the Services without our express written consent.4.2 Commercial Exploitation
(A) Use the Services for any commercial purposes that have not been explicitly endorsed or approved by us.
(B) Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without express permission from us.4.3 Harmful Behavior
(A) Engage in any conduct that could damage, disable, overburden, or impair the functionality or appearance of the Services, including but not limited to hacking, spamming, or introducing malware.
(B) Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or any other material that interferes with the proper functioning of the Services or causes harm to other users.4.4 Impersonation and Misrepresentation
(A) Impersonate, misrepresent, or falsely claim affiliation with any person or entity while using the Services.
(B) Provide false, misleading, or fraudulent information during your use of the Services, including when communicating with us or other users.4.5 Objectionable Content
(A) Post or distribute any content that is illegal, defamatory, harassing, abusive, threatening, obscene, vulgar, or otherwise objectionable.
(B) Use the Services to share or transmit any content that violates the intellectual property rights, privacy rights, or other legal rights of third parties.4.6 Unauthorized Access
(A) Attempt to gain unauthorized access to other users’ accounts, computer systems, or networks connected to the Services.
(B) Interfere with or disrupt the security or integrity of the Services.4.7 Violation of Laws or Regulations
(A) Use the Services in any way that violates any applicable laws, regulations, or guidelines at local, national, or international levels.Payment Terms
5.1 Payment terms, including the fee structure, deposits, and payment schedules, will be outlined and agreed upon in writing prior to the commencement of work.
5.2 In some cases, a non-refundable deposit will be required before the project begins. The remaining balance will be due upon completion of milestones or the final deliverable.
5.3 Failure to pay invoices within the agreed time frame may result in project suspension or termination.
5.4 Any unpaid invoices over 30 days past due may incur interest at a rate of 1.5% per month until paid in full.
Cancellation and Refunds
6.1 In the event the Client wishes to cancel the project after work has begun, any payments made up to the cancellation point will be non-refundable.
6.2 If the Client cancels after project completion, the full payment as agreed must be made.
6.3 Refunds will only be provided in the case of non-performance or significant deviation from the project scope that cannot be remedied.
Intellectual Property Rights
7.1 Matthijs Kok retains ownership of all intellectual property rights in the materials, concepts, and deliverables created during the project, unless explicitly transferred to the Client under a separate agreement.
7.2 Upon full payment, the Client may be granted a limited, non-exclusive license to use the deliverables for the agreed purposes (e.g., marketing, commercial use).
7.3 The Client may not resell, redistribute, or modify the deliverables without prior written consent from Matthijs Kok unless such rights are granted in the contract.
7.4 Any request for transfer of intellectual property rights must be agreed upon and included in the contract and may result in additional fees.
Liability and Indemnity
8.1 Matthijs Kok is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, goodwill, data, or other intangible losses arising from the Client’s use of the deliverables or services.
8.2 The Client agrees to indemnify and hold harmless Matthijs Kok from any claims, damages, liabilities, costs, and expenses (including legal fees) resulting from the misuse of the deliverables or breach of this Agreement by the Client.
8.3 Matthijs Kok is not responsible for any issues or damages caused by third-party vendors, hosting services, or any technical faults beyond his control.
Confidentiality
9.1 Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the course of the project.
9.2 This confidentiality agreement will remain in effect even after the project is completed.
9.3 Any portfolio usage of the final deliverables by Matthijs Kok will only occur with the prior consent of the Client, unless such use is covered under fair use.
Termination
These Legal Terms shall remain in full force and effect while you use the Services.
10.1 Matthijs Kok may terminate the agreement under the following circumstances:
(A) The Client fails to make payments as agreed upon within the specified timeframe.
(B) The Client does not provide the required information, materials, or approvals in a timely manner, significantly delaying or hindering the project’s progress.
(C) The Client repeatedly breaches deadlines, terms, or other essential conditions of the agreement.
(D) The Client engages in inappropriate behavior, unethical conduct, or misconduct that makes further collaboration unacceptable or impractical.
(E) The Client becomes subject to bankruptcy, insolvency, or liquidation proceedings, affecting their ability to fulfill contractual obligations.10.2 The Client may terminate the agreement under the following conditions:
(A) Matthijs Kok fails to deliver services within the agreed deadlines without valid justification or prior notice.
(B) The quality of the work provided by Matthijs Kok consistently fails to meet the agreed-upon standards or requirements despite reasonable opportunities to correct such deficiencies.10.3 Termination Process
(A) Upon termination, both parties agree to settle any outstanding obligations. This includes the payment of any outstanding invoices for services rendered up to the termination date.
(B) In the event of termination by either party, all rights to any work completed prior to termination shall remain with Matthijs Kok until full payment is received, unless otherwise agreed upon.Corrections
11.1 The Services may occasionally contain typographical errors, inaccuracies, or omissions, including but not limited to information related to descriptions, pricing, availability, and other details. We reserve the right to correct any such errors, inaccuracies, or omissions and to modify or update the information on the Services at any time, without prior notice.
